Terms of Service

These Terms of Service (the "Terms") govern access to and use of the RepForm service. For paid subscriptions, they are complemented by the Sales Terms ("CGV").

1. Purpose of the service

RepForm is a web application (SaaS) operated by [RepForm — Legal form to be confirmed], aimed at businesses and professionals in facilities services, maintenance, cleaning, and more broadly any field intervention activity. The service notably enables: intervention scheduling, technician assignment, guided drafting of intervention reports including photos and signatures, branded PDF exports, management of a client, site and contact database, and subscription and team management.

2. Acceptance of the Terms

Access to the service implies full acceptance of the present Terms. If you do not accept all or part of the Terms, you must stop using the service. The Terms are enforceable from account creation, which constitutes acceptance.

3. Capacity and eligibility

The service is intended for professionals (companies, freelancers, associations). The user declares being of legal age, legally capable, and authorised to bind the legal entity on whose behalf the account is created. RepForm reserves the right to request supporting identification or registration documents in case of legitimate doubt.

4. Account creation and management

The user creates an account by providing accurate and up-to-date information. They choose a strong password and keep their credentials confidential. Any action carried out from the account is deemed to be that of its holder. In the event of unauthorised use, the user must notify us without delay at support@repform.app. RepForm may suspend or close an account in the event of breach of the Terms, the Sales Terms, or applicable law.

5. Functional description and changes

RepForm is delivered as a SaaS service, accessible online via a URL. The publisher may evolve the features, ergonomics or architecture of the service without prior notice, provided this does not substantially degrade the subscribed service. The limits associated with each plan (number of technicians, clients, interventions) are described on the pricing page at the time of subscription.

6. Service availability

RepForm is provided on a best-effort basis. The publisher endeavours to ensure 24/7 availability, excluding scheduled maintenance windows. No contractual availability target (SLA) is guaranteed on the free plan. The Starter and Growth paid plans target 99 % monthly availability excluding scheduled maintenance and force majeure events.

7. User obligations

The user undertakes to: (a) use the service in accordance with its intended purpose and applicable law; (b) not attempt to circumvent security, authentication or rate-limiting mechanisms; (c) not perform any operation likely to disrupt the service or other users (denial of service, mass scraping, reverse engineering); (d) not upload illegal, defamatory, counterfeit content or content infringing third-party rights; (e) respect the intellectual property rights of RepForm and third parties; (f) when processing personal data of technicians, clients or contacts via the service, comply with their own obligations as data controller (information, legal basis, security, retention).

8. Intellectual property

The service, its source code, interface, trademarks, logos and all graphical elements are the exclusive property of RepForm. Any unauthorised reproduction, representation, modification or exploitation engages the responsibility of its author. The user retains full rights to the data they import or generate via the service; they grant RepForm the non-exclusive, worldwide, royalty-free licence necessary to host, back up and process that data for the sole purpose of providing the service.

9. Personal data

Personal data processing is described in the Privacy Policy, which is an integral part of these Terms. For business customers processing personal data of their own end-customers or technicians via the service, a Data Processing Agreement (DPA) within the meaning of Article 28 GDPR is available on request at privacy@repform.app.

10. Limitation of liability

RepForm is bound by a best-effort obligation. Its liability cannot be engaged in the event of: (a) misuse of the service by the user; (b) interruption due to force majeure or to an essential technical sub-processor (Vercel, Supabase, Stripe); (c) data loss attributable to the user (voluntary deletion, password sharing, compromised device). To the fullest extent permitted by law, and excluding personal injury, wilful misconduct or gross negligence, RepForm's liability is capped at the amount actually paid by the user over the 12 months preceding the triggering event. Indirect damages (loss of revenue, loss of customers, reputational harm, recoverable data loss) are expressly excluded.

11. Suspension and termination

RepForm may suspend access to the service, without prior notice, in the event of serious breach by the user (violation of the Terms, non-payment, abusive use, behaviour endangering security or other users). Termination of paid accounts is governed by the Sales Terms. A free account may be terminated at any time from the user interface, or by RepForm in the event of prolonged inactivity (12 consecutive months without connection).

12. Changes to the Terms

RepForm may amend these Terms to reflect changes in the service or applicable regulations. Substantial changes are notified by email to the account address or via the application at least 30 days before they take effect. Continued use of the service after that date constitutes acceptance of the new Terms. If you do not accept, you may terminate your account without charge before the effective date.

13. Governing law and dispute resolution

These Terms are governed by French law. In the event of a dispute, the parties will endeavour to find an amicable solution. Failing that, the dispute will be brought before the competent courts in the jurisdiction of RepForm's registered office, except where mandatory law provides otherwise (notably in favour of the consumer).
